To protect your own interests please read our Terms and Conditions carefully before ordering. A person who uses this website and/or orders a Higher Self Portrait is referred to as "CLIENT" or "You".

Your order indicates acceptance of these Terms and Conditions. If you are uncertain as to your rights or want any explanation about our Terms and Conditions please contact us. We invite you to print these Terms and Conditions or we can email them to you upon request. These Terms and Conditions contain the whole of our agreement relating to your purchase including information about our pricing and contact details. They cannot be varied unless an approval to do so is signed by Sonya Shannon (“ARTIST”) or another legal representative of Higher-Self-Portraits.com. If any part of these Terms and Conditions are declared void for unfairness pursuant to the Unfair Terms in Consumer Contract Regulations 1999, or any other reason, the remaining contract shall continue to bind the parties excluding the specific unfair terms exception(s).

Data Protection & Privacy

We are committed to protecting your privacy and providing you with the means to make secure purchases.

Any personal information provided by the customer for orders, account registration or newsletter signup will be used for that purpose only within Higher-Self-Portraits.com. Your information will never be sold or traded to a third party. We will use the contact information provided by you via the website Higher-Self-Portraits.com or via email to communicate with you by email or phone. You also agree to receive information and updates about your order and about special promotions we run. In this section we refer to "personally identifiable information," which is information that enables us to identify you, such as your email address, phone number, name, and postal address. Like many e-commerce web sites Higher-Self-Portraits.com works with PayPal, which is a 100% secure online payment service provider. Our chosen partners are securely managing all customer data in accordance with consumer data protection legislation.

Higher-Self-Portraits.com respects your privacy rights and provides you with an access to the data you may have provided us with. Deposit

Payment of your deposit reserves your scheduled Higher Self Portrait photo session date. Please refer to our Higher Self Portrait Process. The deposit fee is non-refundable; however, the ARTIST will gladly work with you to reschedule due to unforeseen circumstances.

Due to the nature of custom artwork, work on Higher Self Portrait orders will start only after your payment has cleared. The creation time quoted at time of purchase does not include any time required for payments to clear.

The ARTIST reserves the right to refuse a portrait order for any reason.

Payment & PAYMENT PLANS

All artwork and products must be paid for in full at the time of ordering. No custom artwork will be started and no physical item will be shipped until the payment has cleared.

You can place your order using secure encryption (the Internet standard for secure transactions). Our secure payment service provider is PayPal. We offer PayPal Credit to assist Clients in need of payment plans.

Our payment and purchase options are 100% secure for our customers. Higher-Self-Portraits.com intends to provide you with the safest and most secure shopping experience possible. Since offerings and technologies change, we reserve the right to change, modify, add, or remove options of our website at any time without prior notice. 

Approval & Ordering

The ARTIST endeavors to complete all artwork within 60 days upon completion of the photo session.

You will be provided with a preview of your portrait for approval in an online gallery approximately four to six weeks after your photo session. Any changes must be expressed and discussed at this point, as no further "alterations" can be made, as no further changes can be made after final approval.

The art print final outcome will be based on the artwork you approve. Higher-Self-Portraits.com and the ARTIST cannot be held responsible for any issues arising from you being dissatisfied after your approval.

Please allow 2-3 weeks after the approval of your Higher Self Portrait for order delivery. We can only deliver to addresses at which a person will be present to sign for the delivery. No artwork will be left at the door. If you are unable to have someone personally receive the artwork, please let us know so that we can leave it with the delivery service office (e.g. Fedex) for you to pick up at your convenience.

Due to the nature of custom Higher Self Portraits, all sales are final.

Additional Source Photos

Any additional personal, reference, or source photos you may wish to provide need to meet minimum quality requirements. Where possible the photo should be the original, uncompressed version. Photos taken from social media, or otherwise compressed will be eliminated from inclusion in the final artwork, though they may have value to the ARTIST for the overall process and Interpretive Reading. 

Reference photos that do not meet the minimum quality requirement, or are particularly old, degraded or blurred may be liable for a higher charge due to the extra restoration work required.

Delivery of ARtwork

A person must be physically present to receive ARTWORK at the time of delivery. ARTIST and Higher-Self-Portraits.com will not leave valuable artwork outside your door, even if you leave a signature. If you or another person cannot be present to receive the delivery, please let us know. We can make alternative arrangements, such as a secure artwork drop-off (Denver, Colorado), or leaving the artwork at a shipping facility (such as Fedex) where you can retrieve it at your convenience.

Copyright

Even without a prior written agreement, all artwork provided by the ARTIST is for personal use only. The ARTIST maintains the copyright on all images and reserves the right to use the images and/or reproductions for display, publication, or other purposes.

CLIENTS are not permitted to use these images for profit, commercial endeavors, in competitions or for professional displays, except for those licensing the Artwork according to the terms specified in the Practitioner Package License Agreement.

All artwork, photos, and elements created by the ARTIST are protected by Federal Copyright Law. Please respect the ARTIST’S livelihood by adhering to our nation's law! 

Refunds & Returns

Due to the nature of custom-made artwork, the Higher Self Portraits are not eligible to be refunded. Although the portraits cannot be refunded, the ARTIST sends previews before printing or sending the final outcome. Beyond one (1) reasonable change, additional fees may be incurred for changes requested. The ARTIST cannot change the source photo(s) for the portrait once work has begun without additional payment.

Limitation of Liability

Breach. For any breach of this Agreement by ARTIST, the CLIENT’s exclusive remedy and ARTIST’S entire liability will be limited to the amount of compensation received by ARTIST as set forth in this Agreement. IN NO EVENT WILL ARTIST BE LIABLE FOR DAMAGES HEREUNDER THAT EXCEED THE AMOUNTS PAID OR TO BE PAID BY CLIENT TO ARTIST PURSUANT TO THIS AGREEMENT.

Quality of artwork. The ARTIST uses high quality materials, equipment, and state-of-the-art techniques for Portraits. While the stability of print materials has improved greatly in recent years, the CLIENT acknowledges that, over a long period of time, print materials may fade or discolor due to the inherent nature of dyes and emulsions. This process may be accelerated or even slowed depending on storage conditions, exposure to sunlight, extreme heat and temperature or moisture. CLIENT releases the ARTIST from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities. CLIENT assumes full responsibility for following guidelines for placement, care and cleaning of artwork.

General Terms

The ARTIST and Higher-Self-Portraits.com will make every effort to ensure that the website and other services are available continuously, but we reserve the right to modify, suspend, or discontinue all or any part at any time with or without notice. Unless specifically exempted any new features, services, or software applications introduced shall be subject to these Terms and Conditions. We reserve the right to modify or replace these Terms and Conditions at any time. Any change shall be effective immediately it appears on the site. Each time you use the service you are deemed to have accepted any such change. We accept no liability to the fullest extent permitted by law for the accuracy of information contained on the website, which may contain technical inaccuracies or typographical errors. However this provision does not affect your statutory rights and remedies. In no circumstances will the ARTIST, the owner of this domain (Higher-Self-Portraits.com) be liable for any loss or damages, whether direct, or consequential arising out of: (a) your use of the Higher Self Portraits website, services, or your inability to do so; (b) your reliance on any content and/or: (c) goods and services in any way associated with the site and services. We will pay sales taxes on behalf of our customers for orders shipping to the United States as required by the laws of their respective US States. All digital paintings are made to order and are custom made. We reserve the right to alter prices for new orders without prior notice. Prices for orders in progress will not be altered.
